The insurance companies use the numbers here. An example would be if 100% of all theft claims are denied, they know only about 3%-5% of these cases will be contested. In Michigan, the way the laws are set up, it is very difficult to defend these cases financially for the insured and they usually just give up. Our latest trial just changed that in Michigan.
One other thing that insureds don't realize is that their name is put on a database for insurance companies to review so the next time they have any type of theft claim, they may be denied. The way all this is set up is that instead of being presumed innocent until proven guilty, the opposite holds true. You are guilty until proven innocent! Commonly not based on fact, but assumption.
